Terms of Service

1. Acceptance of Terms

By accessing, browsing, posting to, or otherwise using CityTides ("the Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you must not use the Service. We reserve the right to update these terms at any time, and your continued use of the Service after changes are posted constitutes acceptance of those changes.

2. Geographic Availability — Continental United States Only

The Service is intended and made available only for use within the 48 contiguous (continental) United States and the District of Columbia. The Service is not offered or intended for use in Alaska, Hawaii, Puerto Rico, the U.S. Virgin Islands, Guam, American Samoa, the Northern Mariana Islands, or any other U.S. territory, commonwealth, or possession, nor in any other country. Posting of community listings is technically limited to the continental U.S. If you access the Service from outside the continental United States, you do so on your own initiative and at your own risk, and you are responsible for compliance with all applicable local laws.

3. Description of Service

CityTides is a free, publicly accessible website that aggregates local information including weather, tides, gas prices, traffic, restaurants, real estate, events, and community listings for cities across the continental United States. The Service is provided for informational and convenience purposes only.

4. Informational Use Only

The information provided by CityTides is for general informational purposes only. It is not a substitute for professional advice. Specifically:

  • Health and medical information is not medical advice. Always consult a licensed healthcare provider.
  • Weather and tide data should not be used for emergency, navigational, or safety-critical planning without consulting official sources.
  • Real estate and financial information is not financial, investment, or legal advice.
  • For emergencies, always call 911.

5. Accuracy of Information & No Warranty

CityTides aggregates data from third-party APIs and public sources. We make no warranties or representations of any kind about the accuracy, completeness, reliability, currency, or timeliness of any information displayed. Data may be delayed, incomplete, incorrect, or unavailable at any time. You acknowledge and agree that any reliance you place on information from the Service is strictly at your own risk, and that CityTides is not liable for any decision made or action taken based on information from the Service.

6. Community Listings

CityTides allows users to post community listings (Buy & Sell, Housing, services, and similar). By posting content, you represent and agree that:

  • You own or have the right to share the content you post;
  • Your post is accurate, lawful, and not misleading;
  • You will not post illegal, stolen, recalled, hazardous, counterfeit, fraudulent, or harmful items or content;
  • You will not post adult services, weapons prohibited by law, controlled substances, spam, scams, or solicitations outside designated areas;
  • All posts are subject to review and may be removed at our sole discretion, with or without notice.

7. User-to-User Transactions & Assumption of Risk

CityTides is only a venue. Listings are created by and exchanged between independent users. CityTides is not a party to, and is not involved in, any transaction, communication, meeting, sale, trade, rental, or arrangement between users. We do not buy, sell, inspect, test, verify, endorse, guarantee, insure, or take possession of any item, service, or property listed, and we do not vouch for any user, their identity, their statements, or their conduct.

Accordingly, you understand and agree that:

  • You assume all risk arising from any interaction or transaction with another user, including in-person meetings, exchange of payment, and the condition, quality, safety, legality, or fitness of any item or service;
  • CityTides is not responsible or liable for any loss, damage, injury, illness, death, theft, fraud, or other harm of any kind resulting from a user-to-user transaction, from any item or service obtained through the Service, or from your reliance on any listing;
  • Any dispute arising between users is solely between those users, and you release CityTides and its operators from any and all claims, demands, and damages arising out of such disputes or transactions;
  • You are responsible for taking your own safety precautions, including meeting in public places and independently verifying items, services, and the other party.

Payments, deposits, shipping, holds, and other arrangements. CityTides does not process, collect, hold, escrow, transmit, insure, or refund any money, and is not a payment processor or an escrow service. Any price, payment method, deposit, delivery charge, shipping charge, hold, or reserve shown in a listing is information stated by the user who posted it — not an offer, guarantee, or service provided by CityTides. You further understand and agree that:

  • Payment. All payment is arranged and made directly between users, on terms the users set themselves and outside of CityTides. CityTides is not responsible or liable for non-payment, underpayment, overpayment, reversed or charged-back payments, bounced or cancelled transfers, counterfeit funds, fraud, or any other payment problem — regardless of the payment method used, including cash, Venmo, Zelle, PayPal, check, or any other method.
  • Deposits, holds, and reserves. A deposit, "hold," or "reserve" shown on a listing is a term the seller chooses to state and is arranged and paid directly between users. CityTides never receives, holds, applies, or refunds any deposit; does not guarantee that a hold or reserve will be honored by the seller or that a buyer will follow through; and is not responsible or liable for any deposit that is lost, withheld, disputed, not refunded, or applied in a way either party did not expect.
  • Shipping and delivery. Any shipping or local delivery is arranged and carried out directly between users. CityTides does not ship, deliver, package, insure, or track any item, and is not responsible or liable for items that are lost, stolen, damaged, delayed, never sent, or never received, or for any shipping or delivery charge.
  • Both parties accept full responsibility. For any arrangement between users — including payment, deposits, holds, reserves, trades, shipping, delivery, or in-person exchange — both the buyer and the seller accept full responsibility for the arrangement and its outcome. CityTides is not a party to and is not liable for any default, breach, dispute, or loss arising from such an arrangement, and any remedy you may have is solely against the other user and not against CityTides.

8. Prohibited Uses

You may not use CityTides to:

  • Scrape, crawl, or systematically extract data without written permission;
  • Post false, defamatory, or fraudulent information;
  • Harass, threaten, stalk, or harm other users;
  • Attempt to hack, disrupt, or overload our systems;
  • Use the Service for any unlawful purpose.

9. Third-Party Links and Data

CityTides links to and displays data from third-party services including Google, Ticketmaster, TomTom, NOAA, the National Weather Service, and others. We are not responsible for the content, accuracy, availability, or privacy practices of these third parties. Links to external websites do not constitute endorsement.

10. Advertising

CityTides may display advertisements from local and third-party businesses. Advertisers are responsible for the accuracy of their own content. CityTides does not endorse advertised businesses and is not responsible for any transactions between users and advertisers.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or free of viruses or other harmful components.

12. Limitation of Liability

To the maximum extent permitted by law, CityTides and its operators, owners, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, personal injury, or property damage, arising from or related to your use of (or inability to use) the Service, any user-to-user transaction, or any information obtained through the Service, even if we have been advised of the possibility of such damages. To the maximum extent permitted by law, our total aggregate liability for any claim arising out of or relating to the Service shall not exceed one hundred U.S. dollars (US $100).

13. Indemnification

You agree to indemnify, defend, and hold harmless CityTides and its operators, owners, and affiliates from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the Service, your content or listings, your transactions or interactions with other users, or your violation of these Terms or any applicable law.

14. Governing Law

These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict of law principles. You agree that any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Georgia.
